Terms of Use

1. Acceptance of These Terms
These Terms of Use ("Terms") are an agreement between you and Cuya, Inc. ("Cuya," "we," "us") governing your use of the CRACKD mobile game and this website (crackd.cuya.ai). By downloading, accessing, or playing CRACKD, you accept these Terms. If you do not accept them, do not use the game.
Your use of CRACKD is also subject to the terms of the app store through which you downloaded it (the Apple App Store or Google Play). These Terms apply to CRACKD only; they do not modify or describe the terms of any other Cuya product, including Cuya's AI routing platform at cuya.ai, which is a separate product with its own terms.
2. License to Use CRACKD
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use CRACKD on devices you own or control, for your personal, non-commercial entertainment, in accordance with these Terms and the applicable app-store terms. All rights not expressly granted are reserved.
3. Eligibility
You may use CRACKD only if you are legally capable of forming this agreement and meet any age requirements of your app store and jurisdiction. Review final minimum-age language to be set after the Google Play Target Audience declaration and Apple age-rating decision are locked.
4. Free-to-Play Model; No Cash Prizes
CRACKD is free to download and free to play. CRACKD 1.0 does not require you to create a player account and includes no subscriptions. The game may display interstitial advertising, which you can remove through a one-time Remove Ads purchase, and it offers optional in-app purchases (Jewels).
CRACKD does not offer cash prizes, contests, sweepstakes, gambling, or wagering of any kind. Nothing in the game should be understood as an opportunity to win money or anything of value outside the game.
5. Virtual Items — Jewels
CRACKD includes an optional virtual consumable called Jewels, which may be purchased with real money through your app store and spent within the game.
- Jewels are a limited, personal, non-transferable, revocable license to use in-game functionality. You do not own them; they are not property.
- Jewels have no cash value, cannot be exchanged for money or anything of value outside the game, and cannot be redeemed, refunded (except as required by law or store policy), sold, traded, or transferred.
- Jewels and other virtual items may only be used within CRACKD as described in the game.
- Purchasing Jewels — or spending them on assists — does not guarantee that you will complete a level, achieve a particular score, or perform successfully in the game. Assists are optional helpers, not shortcuts that remove the puzzle.
- Retrying a level is always free. No purchase is required to play or to retry.
Jewel balances are stored locally
Jewels are consumable, and in CRACKD 1.0 your Jewel balance may be stored locally on your device; the game does not currently provide cloud synchronization of consumable balances. Unless and until CRACKD expressly provides a cloud-sync or restoration feature for Jewels, we cannot guarantee that unused Jewel balances will survive app deletion, device loss or replacement, operating-system resets, or other loss of local app data, except where required by law or where applicable store functionality supports restoration. Your non-consumable Remove Ads entitlement is addressed separately in Section 7.
6. Optional Gameplay Assists
Jewels may be spent on optional gameplay assists, currently including Reshuffle and Extra Time. Assists are entirely optional: normal retries are always free, and the full game is playable without purchasing anything. We may add, change, or remove assists as the game evolves, subject to Section 12.
7. Remove Ads Purchase
Remove Ads is a one-time, non-consumable purchase that removes CRACKD interstitial advertising. The entitlement is associated with the store account (Apple ID or Google account) used to purchase it. On other devices signed into the same store account, the entitlement can be restored through the mechanisms Apple and Google support for non-consumable purchases, and CRACKD re-checks your entitlement when the game starts online.
Remove Ads applies to CRACKD interstitial advertising. It does not disable messages from the app stores, publisher notices, or legal notices, which are not advertising.
8. Purchases and Billing
All purchases are billed and processed by Apple or Google through your App Store or Google Play account — not by Cuya. Prices, taxes, payment methods, and billing disputes with the store are governed by the applicable store's terms and policies.
Refunds for in-app purchases are subject to applicable law and the refund policies of Apple or Google. Refund requests should generally be made through the store from which you purchased (see the Support page for guidance). Where the law gives you refund rights that cannot be excluded, nothing in these Terms limits them.
9. Advertising
CRACKD is free to play and may display interstitial advertising served by third-party advertising services, unless you have purchased Remove Ads. Your interaction with any advertisement is governed by the advertiser's or ad network's own terms and policies. Data handling related to advertising is described in the Privacy Policy.
10. User Conduct
You agree not to, and not to help others to:
- cheat, hack, use exploits, bots, automation, or unauthorized third-party software in connection with the game;
- tamper with, reverse engineer, decompile, or attempt to derive source code from the app (except to the extent permitted by law);
- interfere with or disrupt the game, its services, or other players;
- circumvent purchase, entitlement, or ad-removal mechanisms, or exploit pricing or transaction errors;
- use the game or its assets for any commercial purpose without our written permission; or
- use the game in violation of any applicable law or regulation.
Exploiting a bug or transaction error is not protected by these Terms — if you find one, please report it through support.
11. Intellectual Property
CRACKD — including its code, design, levels, artwork, audio, text, the CRACKD name and mark, and all related intellectual property — is owned by Cuya, Inc. or its licensors and is protected by copyright, trademark, and other laws. These Terms grant you no rights in any of it beyond the limited license in Section 2.
12. Game Availability, Updates, and Changes
We may update, change, or discontinue the game or any part of it (including levels, features, virtual items, and assists) at any time, including to fix bugs, comply with store requirements, or improve the game. Updates may change how the game plays. We do not guarantee the game will be available uninterrupted, error-free, or indefinitely.
These rights are not a license to erase what you paid for: Cuya will not intentionally eliminate or devalue paid virtual items solely to avoid honoring valid purchases, subject to technical, security, legal, platform, or service requirements. If CRACKD or a paid feature is discontinued, the treatment of unused paid virtual items will be addressed in accordance with applicable law and applicable platform requirements.
13. Termination
Your license under these Terms ends if you materially breach them. CRACKD 1.0 has no user-account system, so termination does not involve deactivating an account: it means your license to use the game ends, and we may take reasonable measures available to us — such as through app updates or mechanisms provided by the app stores — consistent with applicable law. You may end the agreement at any time by ceasing to use and uninstalling the game. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.
14. Disclaimer of Warranties
THE GAME AND THIS WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THAT CASE, ONLY THE DISCLAIMERS PERMITTED BY LAW APPLY TO YOU.
15. Limitation of Liability
Review the cap amount and structure below require legal confirmation before publication.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUYA, INC. AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE GAME. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE GAME WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN CONNECTION WITH THE GAME IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) US $10. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
16. Governing Law and Disputes
Review Governing state, venue, and whether any arbitration or class-action provisions should exist must be decided by counsel before publication. Delaware (the state of incorporation) is not presumed to be the correct contractual choice. No arbitration or class-action waiver regime is included in this draft by design; that decision is left to legal review.
These Terms are governed by the laws of the State of [●], United States, without regard to its conflict-of-laws principles, except where mandatory consumer-protection law of your place of residence applies. If you have a dispute, please contact us first — many issues can be resolved directly. Any legal proceeding will be brought exclusively in the state or federal courts located in [●], and you consent to their jurisdiction, subject again to any mandatory local consumer protections.
17. Changes to These Terms
We may update these Terms as the game evolves. When we do, we will revise the "Last updated" date at the top of this page, and material changes will be announced where appropriate (such as through app-store update notes or in-game notices). Continued use of the game after changes take effect constitutes acceptance of the updated Terms.
